Mike Gableman's eyewitness testimony

"[Gableman] described Bradley as being a little bit taller than Prosser and compared Bradley's stance with Prosser to a famous photo of then-Sen. Lyndon B. Johnson leaning over a shorted [sic], cowed senator. According to the records, however, Prosser is 5-feet-9-inches tall and weighs 165 pounds. Bradley is 5-feet-3-inches and weighs 131 pounds."

Witness credibility issues?

Gableman also claimed that Prosser never came in contact with Bradley's neck despite Prosser's admission that he had both hands on Bradley's neck and "felt its heat." Despite this, Gableman could confidently tell Justice Bradley, "You were not choked." Why should we believe him?

Mike Gableman has lied before. Just ask the Wisconsin Judicial Commission, whose investigation into this altercation is ongoing, despite Justice Prosser's 48-point bold triumphalist WISGOP press release.

What a mess.

Although Gableman is clearly taking some liberties there, I can say with confidence there is absolutely no way Prosser is 5'9", regardless of how he describes himself. Probably 5'6".

I saw Prosser's entire swearing-in speech on teevee, where he was surrounded by at least a half dozen Republicans, facing the adoring audience.

If he's 5'6, they're all under 5'8. Cue Randy Newman.

BTW, he singled out Gableman with effusive praise.

Some context please, Meade. I didn't say Prosser strangled anybody. I was referring to the law of self defense and the relative use of force that's allowable in response to perceived threats: "You don't get to strangle somebody who merely raises their hands," is what I said. Nor would a person get to flog, knife, or shoot another person who merely raised their hands.

The 'he said/she said' of all of this (never mind what Gaybleman said, or claims to have seen, it appears he can't be trusted to not screw up a burnt out match) has amounted to suggesting former GOP representative Prosser can simply be an a@@ and apparently got too worked up about helping the GOP in his former body (perhaps there's an email trail of this, or phone records of contacts). Perhaps he assumed his position of leadership in the Assembly years ago by being just a really super nice guy, but the reality is more likely he herded all those cats with egos the same way LBJ did. That mentality won't work with 6 other people in a branch where persuasion and reasoning would be the currency of the realm instead of tantrums and bitchiness.

That being said, its weird how he used to support the Chief Justice, but now its mostly him and his co-campaigning sorority sister as a pair against the world (as the least blessed on the bench, maybe Gaybleman can be forgiven him for not being able to tell who is taller and where his hands were).

"Oh my God, I'm touching her neck," Prosser said he thought, adding later, "What does any self-respecting man do when suddenly that man finds that his hands, or part of his hands are on a woman's neck? Get them off the neck as soon as possible."

When Prosser was asked by detectives if he felt he needed to apologize, he said he had talked with people about doing that but felt he had done nothing wrong."

In particular Prosser's email to the court notifying them in advance of his concurring opinion in Huebsch v. Dane County, which the others claim not to have received, and which seems to have been the underlying cause of the June 13 brouhaha.

this just in. althouse shocked to learn that some convenient fact she read "elsewhere" was wrong:

"By the way, contrary to what I've read elsewhere, it turns out Prosser is 5'9" and Bradley is 5'3"."

It's a ten minute walk from the UW law school to the Supreme Court hearing room, where Prosser has presided for 13 years (and Bradley for 16). I wonder if there are any other professors of the law who've never seen them in action.

at least gableman didn't compare justice bradley to the pictures of lbj picking up his beagle by its ears or showing reporters his gall bladder surgery scar.

the truth is that prosser isnowhere near 5'9". I'm 5'8", and he's a lot shorter than I am.

Wonder if Gableman's having second thoughts about the "social science studies that were manufactured at colleges and universities" in State v. Tyrone Dubose that he mocked.
