The Alaska Supreme Court today granted a McCain campaign emergency motion pursuant to the latter's continuing efforts to put a halt to that State's legislative investigation into AK Gov. Sarah Palin's alleged abuse of power, a.k.a. Troopergate.*The lead attorney is Kelly Shackelford, who originates from another one of these so-called "pro-family" recreational litigation boutiques, the Liberty Legal Institute out of Plano, Texas.
Yesterday, a lower court shot down the McCain gang's latest attempt at keeping a committee of the Alaska legislature from releasing its report into Troopergate, which is reported to appear on October 10.
Shackelford's emergency motion contains claims of "irreparable harm" to the named plaintiffs, a group of Alaska Republicans, and a rather highfalutin appeal to Marbury v. Madison meant to demonstrate the extreme gravity of the situation (and apparently by extension the extreme danger to the Palin-McCain designs on the U.S. presidency).
The Alaska Supreme Court has scheduled oral arguments for 3:00 p.m. local time next Wednesday and should issue a decision sometime Thursday, Oct. 9. I believe the AK Supreme Court allows video cameras, so we might get some live C-SPAN action.
A positive outcome for the McCainiacs would presumably suppress the release of the contemplated report. The documents, including yesterday's opinion, are posted at the Alaska Court System's website.
* There is also a companion case, among whose defendants are "Seven Subpoenas," a Democrat, and a Republican.

Originally, the report was to be issued Oct. 30, which scared the hell out of the McCainiacs. If the AK supremes rule for the GOP, does that mean the Oct. 30 release date will stand?
No, the Republicans are asking for the committee itself to be declared invalid, and for a permanent injunction on its report. If they succeed in the AK Supreme Court, there will be no report at all.
