It is definitely the same one. Do DA's have to carry malpractice insurance? I can't imagine his carrier is pleased with him acting outside the scope of his elected position. In fact, I wonder how much of a reach it would be to smack him with an SCR violation for giving legal advice as a prosecutor. He's not supposed to render opinions to schools...
Where the hell is J. B. Van Hollen on this? If he can issue an opinion about the legality of open carry, surely he can reassure Wisconsin's public schools that including contraceptive information in sex education classes would not open them up to charges of child abuse or contributing to the delinquency of a minor. Only a partisan hack would shirk his responsibility by staying silent...oh, wait.
I haven't seen anybody mention if this is the same Scott Southworth from Regents v. Southworth. Sounds like a good bet, though.
