And there's lots and lots of brilliant lawyerly folks who don't violate the code of judicial ethics. (Some reading this right now, I bet.)
Anyway Kloppenburg needs to concede, unless the torrent of silliness* issuing from Prosser and his entourage today puts her in mind to get arbitrary and capricious, which to be honest I wouldn't blame her for.
* e.g., "'We will take every and any step to prevent this frivolous matter going forward.' ... Troupis declined to specify how he could challenge a recount request by Kloppenburg." Obviously he couldn't, because he's speaking from his dorsal regions. However Counselor Troupis should indeed know a thing or two about frivolous matters.

Just curious, why do you think Kloppenburg should rush to concede. Most likely this is the only political office she'll ever run for, so why shouldn't she ask for a recount or at least wait until the GAB's Waukesha report comes in?
Personally I don't think she could find enough votes, and as a practical political matter, the sight of Al Franken's lawyers scrutinizing every ballot with an electron microscope would sicken a goodly portion of so-called independent voters.
It's really remarkable that they think this bombthowing is going to help close the door on this. Buncha James Baker wannabes.
It's only gonna get worse. Now here come the recall elections.
I am very glad I have found your website. It is very well done and very accurate.
I hope she does ask for a recount. When an election becomes as close and contested as this one is, in many ways it stops being about the candidate and more about the process and honoring every last person's vote. I remain bitterly disappointed that Kerry rolled over in 2004 and the story of Ohio stayed mostly buried.
I hear ya but the political cost would be massive.
